Since her election in 1988, District Attorney Nola Foulston has created a new respect
for law enforcement in Sedgwick County.
For the past twenty years, Nola Foulston has represented the citizens
of our community as its District Attorney. 
 
Nola Foulston has created a professional prosecution office that has received local, state and national acclaim for its fair and balanced approach to the administration of justice.

 

Confidence and trust have been the hallmark of the District Attorney's office. Through her tireless devotion to the people she serves, and through her willingness and ability to tackle the big jobs and effectively get them done,

Nola Foulston has established unparalleled standards of performance

for the Office of the District Attorney.

 

In the administration of her office, Nola Foulston personally presides over the Felony Review Committee where law enforcement officers and prosecutors meet to consider the filing of all homicides and violent crimes that are committed in our community. Mrs. Foulston has created and works closely with the many special divisions in her office including the following: Capital Litigation, Trial, Gang, Domestic Violence, Sexual Assault, Child Fatality, Vehicular Fatality, Financial Crimes, Elder Abuse, Child in Need of Care, Juvenile Offender Prosecution, Diversion Programs, Consumer Fraud, Traffic, Probate and the Appellate Division that process thousands of cases each year.

As an experienced and skilled trial attorney, Mrs. Foulston has personally prosecuted many complex cases. As an Assistant District Attorney in the administration of District Attorney Vern Miller, Nola Foulston and Sharon Werner (now head of the Consumer Fraud Division of this office) developed the first comprehensive prosecution unit for sexual assaults and crimes against children, continuing today as a most important unit in her office working with the most vulnerable of victims. During those formative years in prosecution, Nola Foulston honed her trial skills and prosecuted innumerabe cases and jury trials of cases from misdemeanors to felonies and homicide cases.

State v. Doil Lane -The defendant was charged and convicted of aggravated kidnapping, first-degree murder, and rape in connection with the
 abduction and murder of nine year old Nancy Shoemaker pictured below.

State v. Donald Wacker - Convicted of kidnapping and aiding a felon in connection with the abduction of nine year old Nancy Shoemaker.

 

 State v. Arturo Garcia - The Club Mexico triple homicide case. Defendant killed three victims and then dismembered and burned their bodies. The defendant was convicted of 2 counts of first-degree murder and 1 count of intentional second-degree murder, and sentenced to the hard 50 sentence (50 years imprisonment without parole) for each first-degree murder conviction and to 165 months in prison for the second-degree murder, to be served consecutively for a sentence in excess of one-hundred years.

State v. Jonathan and Reginald Carr - Death Penalty case for the murders of Anne Walenta, Heather Mueller, Jason Befort, Aaron Sander and Brad Heyka; and the violent crimes committed against H.G. and Andy Schreiber.

 

 Kansas v. Leroy Hendricks - Upholding the constitutionality of the Kansas Sexual Predator Law by the United States Supreme Court.

 

State v. Dennis Rader - The BTK Serial Killer case for the murder of Joseph and Julie Otero and their young children Joey and Josephine, and other victims Kathryn Bright, Nancy Fox, Shirley Vian, Dolores Davis, Marine Hedge, and Vicki Wegerle.

State v. Vincent Altum - Felony murder/child abuse death of 14 month old

State v. Shane Duke - A murder by arson of local businessman

Charles Pettegrew. Defendant was charged and convicted of aggravated robbery, arson, and unlawful possession of a weapon. He was sentenced to the Hard 40 (forty years before parole eligibility).

 

State v. David Williams - 1st degree murder of his former wife and multiple sexual assaults of three young girls ages 12, 14 and 16, including his own daughter. The defendant had only recently been released on parole after serving a sentence for another sexual assault.  

 

State v. Alan Kingsley - The defendant was charged with first degree murder, robbery and forgery in connection with the murder of Donna Jabara Baker. Defendant was sentenced to life without parole for 40 years plus consecutive charges of 15 years to life and 1 to 5 years, respectively.  

 

State v. Richard Mears - The defendant was charged and convicted of Attempted First Degree Murder, Aggravated Assault on a law enforcement officer and Unlawful Possession of a firearm. He was sentenced as a repeat offender under the Habitual Criminal Act.

 

State v. Maurice Kimsey and Robert Swanson - These defendants were escaped convicts from Texas who had robbed a bank in Nebraska and were travelling through Kansas when they were stopped by Highway Patrol Trooper J. Hersh.  Trooper Hersh was critically wounded during the course of his law enforcement duties investigating suspicious activities of these defendants. The defendants escaped and subsequently kidnapped a Valley Center woman who was held hostage and later escaped.

 

State v. Sakone Donesay - Capital Murder of Sedgwick County

State v. Washington, Tucker, Ferguson and Evans - Aggravated Kidnapping, robbery and multiple sexual assaults (32 counts in all) on 2 women and one man working at the Cottage of Flowers Shop on South Emporia.

 

 State v. Cain Dixon -  A domestic violence case that escalated into the shotgun murder of his wife Bonnie Dixon in Wichita after she had fled from Topeka to safety in Wichita. Her children were present at the time of her murder. He was charged and convicted of first-degree murder, attempted first-degree murder, and aggravated burglary.
